Husky Outdoor Services

Master Service Agreement & Terms of Service

Effective upon scheduling, estimate approval, enrollment in any service plan, or receipt of services.

1. Acceptance of Terms

By approving an estimate, enrolling in a maintenance plan, submitting payment, or allowing services to be performed, Client acknowledges and agrees to all terms contained in this Master Service Agreement.

2. Scope of Work

Services may include but are not limited to:

  • Lawn mowing and turf maintenance

  • Landscape maintenance and mulch installation

  • Shrub and plant trimming

  • Seasonal cleanups

  • Christmas light installation and removal

  • Snow removal and winter response services

Only services listed on an approved estimate or active plan are included.

3. Independent Contractor Status

Husky Outdoor Services operates as an independent contractor. No partnership, employment, joint venture, or agency relationship is created.

4. Access & Property Disclosure Requirements

Client agrees to:

  • Provide unobstructed and safe access

  • Remove debris, toys, hoses, and pet waste

  • Clearly mark sprinkler heads, irrigation lines, invisible fences, drainage, and underground systems

  • Disclose fragile materials, loose hardscapes, or hidden hazards

Husky is not responsible for damage to unmarked or undisclosed property features.

5. Assumption of Risk

Client understands that exterior property maintenance involves inherent risks including:

  • Debris propulsion

  • Turf stress

  • Weather-related damage

  • Equipment-related surface wear

By authorizing service, Client assumes ordinary risks associated with lawn and landscape maintenance.

6. Damage Limitation & Claims Procedure

  • Any claim must be submitted in writing within 48 hours of service

  • Failure to report within this timeframe constitutes waiver of claim

  • Husky’s total liability shall not exceed the amount paid in the previous 30 days

  • Husky is not liable for indirect or consequential damages

7. Turf & Plant Health Disclaimer

Husky does not guarantee turf or plant health due to:

  • Weather conditions

  • Irrigation practices

  • Soil quality

  • Disease or pests

8. Snow & Ice Liability

  • Husky does not guarantee ice-free conditions

  • Refreezing may occur after service

  • Client assumes responsibility for slip hazards

Vehicle pull-outs are performed at client risk.

9. Holiday Lighting Disclaimer

  • Client provides power access

  • Husky not responsible for electrical issues or aging roofs

  • Weather may affect lighting performance

10. Payment & Collections

  • Invoices not paid by the due date may be subject to late fees where permitted by law.

  • A late fee may be applied to balances not paid within 7 days of the invoice date.

  • Additional fees may be applied to accounts that remain unpaid beyond 14 days.

  • Husky Outdoor Services reserves the right to pause or cancel services on any past due account.

  • Clients with outstanding balances may be removed from the service schedule until payment is received in full.

  • Repeated late payments may result in required prepayment or auto-pay enrollment for continued service.

  • Payment due upon completion

  • Auto-pay required for plans

  • 7+ days late = service suspension

  • Client responsible for collection/legal fees

11. Price Adjustments

Pricing may change due to fuel, materials, or scope changes.

12. Commitment Plans & Early Termination

  • Clients are responsible for minimum terms

  • Early cancellation may trigger rate adjustments

  • Route spots are not guaranteed after cancellation

13. Reactivation & Overgrowth

Overgrown or paused properties may incur additional fees.

14. One-Time Service Conversion

  • Weekly plans are not one-time services

  • Canceling after first visit = reclassified as one-time

  • One-time rate: $55 per visit

15. Force Majeure

Husky is not liable for delays due to:

  • Weather

  • Equipment failure

  • Government actions

16. Indemnification

Client agrees to protect Husky from claims caused by:

  • Hidden hazards

  • Property conditions

  • Third-party incidents

17. Dispute Resolution

Disputes must be submitted in writing and handled through arbitration in Oklahoma.

18. Severability

Invalid sections do not void the rest of the agreement.

19. Entire Agreement

This document represents the full agreement.

 

 ADDITIONAL PROTECTION CLAUSES

20. Photo Documentation

Husky may take photos for proof of service and disputes.

21. Chargebacks

Client agrees not to file chargebacks without contacting Husky first.
Fraudulent disputes may result in collections/legal action.

22. Non-Solicitation

Clients may not hire Husky workers privately for 12 months.

23. Unsafe Property Refusal

Husky may refuse service due to unsafe conditions.

24. Equipment Disclaimer

Normal equipment use may cause minor wear or impressions.

25. Missed Service / Skip Fees

Access issues may still result in charges.

26. Communication Responsibility

Client must maintain accurate contact info.

27. Service Satisfaction Window

Issues must be reported within 48 hours.

28. No Guarantee Clause

Exact visual results are not guaranteed.

29. Service Modifications

Husky may adjust methods or scheduling as needed.

30. Marketing Use

Photos may be used for marketing unless requested otherwise.

31. Scheduling Variability

Arrival times may vary.

32. Service Area Limits

Service is limited to active route areas.

33. Zero Tolerance Policy

Abuse or threats = immediate termination.

34. Estimate Accuracy

Quotes may be adjusted after first service if needed.

35. Fuel Adjustment Clause

Pricing may adjust due to operational cost changes.

36. Governing Law

This agreement is governed by Oklahoma law.

37. PROPERTY CONDITIONS & SERVICE RESULTS

Client understands that final service appearance may be affected by existing property conditions beyond Husky Outdoor Services’ control, including but not limited to:

  • Uneven terrain

  • Broken, buried, or lifted edging surfaces

  • Overgrown borders

  • Excessive weeds or prior neglect

  • Mud, soft ground, or saturated soil

  • Poor turf health or thinning grass

  • Root intrusion

  • Rock displacement

  • Hidden obstacles or debris

Husky Outdoor Services will perform all services to a professional standard based on current site conditions, but does not guarantee flawless cosmetic results where pre-existing property conditions limit achievable outcomes.

Refunds will not be issued for results impacted by pre-existing property conditions.

38. corrective restoration services

If additional labor, restoration, or improvement is requested beyond standard maintenance due to pre-existing conditions, corrective services may be quoted separately at current rates.

39. INITIAL VISIT EXPECTATIONS

For neglected or overgrown properties, the first visit may focus primarily on bringing the property back under control. Best visual results are often achieved through ongoing recurring maintenance rather than a single visit.

40. Binding Acceptance of Terms, Payment Enforcement & Collections

By requesting an estimate, approving a quote, submitting payment, enrolling in any plan, scheduling service, or allowing Husky Outdoor Services to perform work on the property, Client acknowledges that they have read, understood, and agree to be fully bound by all current Terms, Policies, and Service Conditions of Husky Outdoor Services.

Use of Husky Outdoor Services constitutes full acceptance of these terms whether agreed verbally, electronically, in writing, online, or by conduct through acceptance of service.

All approved estimates, completed services, recurring plans, invoices, and balances due remain legally enforceable obligations of the Client.

Invoices not paid by the stated due date may be considered delinquent. Husky Outdoor Services reserves the right to suspend or cancel future services, remove Client from recurring schedules, assess applicable late fees where permitted by law, and pursue recovery of unpaid balances.

Unpaid accounts may be referred to a third-party collection agency or legal action may be pursued without further notice.

Client agrees to be responsible for all costs associated with collection of unpaid balances, including but not limited to:

  • Collection agency fees

  • Court costs

  • Filing fees

  • Reasonable attorney fees

  • Administrative recovery costs

Failure to pay for completed services may affect eligibility for future service.

Husky Outdoor Services reserves the right to update or modify policies at any time, with updated terms becoming effective upon publication or notice to Client.
