Master Service Agreement & Terms of Service
Effective upon scheduling, estimate approval, enrollment in any service plan, or receipt of services.
1. Acceptance of Terms
By approving an estimate, enrolling in a maintenance plan, submitting payment, or allowing services to be performed, Client acknowledges and agrees to all terms contained in this Master Service Agreement.
2. Scope of Work
Services may include but are not limited to:

Lawn mowing and turf maintenance
-
Landscape maintenance and mulch installation
-
Shrub and plant trimming
-
Seasonal cleanups
-
Christmas light installation and removal
-
Snow removal and winter response services
Only services listed on an approved estimate or active plan are included.
3. Independent Contractor Status
Husky Outdoor Services operates as an independent contractor. No partnership, employment, joint venture, or agency relationship is created.
4. Access & Property Disclosure Requirements
Client agrees to:

Provide unobstructed and safe access
-
Remove debris, toys, hoses, and pet waste
-
Clearly mark sprinkler heads, irrigation lines, invisible fences, drainage, and underground systems
-
Disclose fragile materials, loose hardscapes, or hidden hazards
Husky is not responsible for damage to unmarked or undisclosed property features.
5. Assumption of Risk
Client understands that exterior property maintenance involves inherent risks including:

Debris propulsion
-
Turf stress
-
Weather-related damage
-
Equipment-related surface wear
By authorizing service, Client assumes ordinary risks associated with lawn and landscape maintenance.
6. Damage Limitation & Claims Procedure

Any claim must be submitted in writing within 48 hours of service.
-
Failure to report within this timeframe constitutes waiver of claim.

Husky’s total liability for any claim shall not exceed the amount paid for services within the preceding 30 days.
-
Husky shall not be liable for indirect, incidental, special, or consequential damages.
7. Turf & Plant Health Disclaimer
Husky does not guarantee turf or plant health due to variables outside its control, including:

Drought
-
Overwatering
-
Soil deficiencies
-
Fungal disease
-
Pest infestation
-
Pet activity
Husky is not responsible for lawn discoloration, thinning, or plant loss resulting from environmental factors.
8. Snow & Ice Liability
Snow removal services reduce accumulation but do not eliminate all slip hazards.
Client acknowledges:

Refreezing may occur after service.
-
Ice may remain beneath packed snow.
-
Husky does not guarantee ice-free conditions.
Client assumes responsibility for post-service slip-and-fall conditions.
Vehicle pull-outs are performed at Client’s risk. Husky is not liable for mechanical damage, drivetrain strain, or pre-existing vehicle conditions.
9. Holiday Lighting Disclaimer

Client must provide safe and functional power access.

Husky is not liable for electrical faults caused by existing wiring.

Extreme weather may impact light performance.
-
Roof clip installation may stress aging shingles; Husky is not liable for pre-existing roof weaknesses.
10. Payment & Collections

Payment is due upon completion unless otherwise agreed.

Maintenance plans require auto-pay enrollment.
-
Accounts 7+ days past due may be suspended.
-
Returned payments incur administrative fees.
-
Client agrees to pay all collection costs, including legal fees, court costs, and interest, if account becomes delinquent.
11. Price Adjustments & Material Fluctuation
Husky reserves the right to adjust pricing due to:

Fuel cost increases
-
Material cost fluctuations
-
Property size changes
-
Service scope expansion
Clients will be notified prior to adjustment.
12. Commitment Plans & Early Termination
Clients enrolled in commitment-based plans remain responsible for agreed minimum terms.
Early termination may result in:

Loss of promotional pricing
-
Retroactive adjustment to standard rates
-
Immediate billing of outstanding balance
Route availability is not guaranteed after cancellation.
13. Reactivation & Overgrowth
Properties requiring excessive cleanup due to service interruption may incur reactivation or overgrowth fees.
14. Force Majeure
Husky is not liable for failure to perform due to events beyond reasonable control, including:

Severe weather
-
Natural disasters
-
Equipment breakdown
-
Government restrictions
-
Labor shortages
15. Indemnification
Client agrees to indemnify and hold harmless Husky Outdoor Services from claims arising from:

Undisclosed property hazards
-
Third-party injuries due to property conditions
-
Client negligence
16. Dispute Resolution & Arbitration
Client agrees that any dispute shall first be submitted in writing for resolution.
If unresolved, disputes shall be resolved through binding arbitration in the State of Oklahoma prior to litigation.
17. Severability
If any provision of this agreement is deemed unenforceable, remaining provisions remain in full effect.
18. Entire Agreement
This document constitutes the entire agreement between Husky Outdoor Services and Client.
